Abstract : Free and compulsory education for all the children in the age group of 6-14, it was enshrined in the Indian Constitution as a Directive Principle of State Policy in Article 45 to provide free and compulsory education to all children until they complete the age of 14 years within 10 years from the commencement of the constitution. It was not feasible due to financial condition of the state to make it a Fundamental Right under Part-III of the Indian Constitution and therefore, included it in the Chapter IV of the Constitution. While relying on effective and honest implementation of this directive, they expected to abolish illiteracy from the country within stipulated time, but their expectation remained in vain. The Right to Education Act was finally made a fundamental right of Indian children in the age group of 6-14 to get free and compulsory education. The 86th Amendment introduced new Article 21A, making the right to education of children from 6 to 14 years of age a fundamental right. Article 51A (K) was added to Part IV-A of the Constitution as a fundamental duty of parents to provide opportunities for education to their children aged between 6 and 14.
